Terms of service
Version 2026-11-08. The contract language is English.
1. Who we are
songg is operated by Tibor Czekay, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany ("songg", "we"). Contact: info@tiborczekay.com.
2. Who can use songg
You must be 18 or older. These terms apply to consumers and businesses. Where a rule applies only to consumers, we say so.
3. What songg does
songg generates original music from a text description. We use Google's Gemini and Lyria models to turn your description into a track and deliver it as MP3 and MP4 files. Generation is automated. We don't promise that a track matches your expectations, that it's unique, or that no similar track exists.
4. How the contract is made
You choose a plan on songg.app and complete payment through Stripe Checkout. The contract is made when you click the final payment button. We then send a confirmation email with these terms' version, your plan and your consent. We don't keep a separate copy of the contract text for you; save the email or this page.
5. Plans, credits and prices
| Plan | Monthly | Yearly | Credits |
|---|---|---|---|
| Creator | €12 | €120 | 60 per month (720 per year) |
| Pro | €29 | €290 | 160 per month (1,920 per year) |
| Brand | €99 | €990 | 600 per month (7,200 per year) |
All prices are final prices in euros. We are a small business under § 19 UStG and don't charge VAT, so no VAT is added or shown on invoices.
One credit makes one track of 5 to 60 seconds, with vocals or instrumental. Plan credits are granted at the start of each billing period and expire at its end. Yearly plans receive all credits at the start of the year. Top-ups (25 credits for €6) don't expire but can only be used while a plan is active. Plan credits are used before top-up credits. If a generation fails, the credit is returned automatically.
When you upgrade, the new plan starts immediately: you receive the difference in credits and Stripe charges the prorated difference. Downgrades take effect at the end of the current period.
6. Payment and renewal
Stripe processes payments. Your plan renews automatically for the same period (month or year) until you cancel. If a payment fails, you can't make new tracks until it succeeds, but you can still download your library.
7. Cancellation
You can cancel at any time, effective at the end of the current billing period, in your account, through the billing portal, or with the "Cancel contracts here · Verträge hier kündigen" button at the bottom of every page. The right to terminate for good cause is unaffected. We may cancel with 30 days' notice to the end of a billing period, or immediately for good cause, such as serious breach of section 9.
After your plan ends, you can download your tracks for 90 days. We email you at least 7 days before we delete them.
8. Right of withdrawal (consumers)
Withdrawal information
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is made.
To exercise your right of withdrawal, you must inform us (Tibor Czekay, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany, info@tiborczekay.com) by a clear statement, for example by email, or use the "Withdraw from contract · Vertrag widerrufen" button on our website. You can use the model form below, but you don't have to. To meet the deadline, it's enough to send your notice before the withdrawal period ends.
Effects of withdrawal
If you withdraw, we refund all payments we received from you without undue delay and no later than 14 days after we receive your notice. We use the same payment method you used, unless agreed otherwise; you won't be charged any fees for the refund.
Early expiry
Your right of withdrawal expires once we have started delivering digital content (your first generated track), provided you expressly agreed that we start before the withdrawal period ends, acknowledged that you lose your right of withdrawal by agreeing, and we confirmed this to you. You give this agreement at checkout.
Model withdrawal form
To Tibor Czekay, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany, info@tiborczekay.com: I hereby withdraw from the contract I concluded for the following service: songg plan ______. Ordered on: ______ Name: ______ Address: ______ Date: ______
9. Your descriptions and use of tracks
You're responsible for what you type. Don't ask songg to imitate real artists, songs or voices, or to create unlawful, hateful, sexual or deceptive content. We may block requests and suspend accounts that break this rule.
We don't claim any rights in your tracks. You may use them for any lawful purpose, including commercial use. AI-generated music may not be protected by copyright, so we can't grant you exclusive rights, and others may create similar tracks. If you use vocals in a way that could make people think a real person sang them, you must label the content as AI-generated. Details: Using your tracks.
10. Availability
We aim to keep songg available but don't guarantee uninterrupted service. Maintenance and provider outages (for example at Google, Cloudflare or Stripe) can interrupt generation.
11. Liability
We're liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we're liable only for breach of essential contractual obligations, limited to the typical, foreseeable damage. Otherwise our liability is excluded. These limits also apply to our agents.
12. Changes to these terms
We may change these terms for future billing periods with at least 6 weeks' notice by email. If you object before the change takes effect, the old terms continue until you or we cancel. We'll explain this right in the notice. If you don't object, the new terms apply.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this doesn't remove the protection of mandatory law in the country where you live. If you're a merchant, the courts at our place of business have jurisdiction. We're neither willing nor obliged to take part in consumer arbitration proceedings (§ 36 VSBG).
